Wisconsin Dells District Attorney Holds Body From June 29, 2007 Vehicular AccidentMadison WI Criminal Law Defense Attorney Christopher Van Wagner CommentsWisconsin Dells, WI. 8/3/07On June 29, 2007, Olga Ivanenko, a 19-year old Ukrainian woman died from head injuries sustained in an automobile accident in Wisconsin Dells. In an interview with Susan Lampert, Wisconsin State Journal, Wisconsin Dells District Attorney Jane Kohlwey said that the Columbia County district attorney's office (Wisconsin Dells WI) must hold Ms. Olga Ivanenko's body because it is evidence in a very serious criminal matter. District Attorney Kohlwey said she could not authorize release of evidence because the evidence must be available for defendant or defense witnesses to examine. The Wisconsin Dells medical examinar completed a full medical exam the day after the accident - June 30th. The alleged defendant in the case - Andrii Pomaz - was charged with homicide by negligent use of a vehicle by the Columbia County DA on July 13th and moved from facilities for deportation in Dodge County to Columbia County jail. Pomaz does not have a defense attorney. Legal analyst and criminal law defense attorney Chris Van Wagner said he understands why prosecutors want to hang on to the body, so the defense can't appeal on that basis. But if the autopsy shows there is little question how the teen died, Van Wagner said the district attorney "could take the high road and ask a judge to release the body." Olga Ivanenko's parents, the Ukrainian embassy and Ryan Lenzendorf, a Wisconsin Dells funeral director have begged Columbia County to release the body for burial, but to no avail.
