Forfeitures

A forfeiture is an order of the court mandating the surrender of property to the court. In most instances, a forfeiture mandates the surrender of money to the court (also called a fine), but the court may order the surrender of personal property such as an automobile or real property, being land or a building. For example, if you are convicted of drunk driving, Wisconsin law allows a court to order a vehicle to be seized for forfeiture whnever its owner is convicted of a third or subsequent drunk driving violation.

Forfeitures are classified as follows: Class A, B, C, D, or E.

Criminal Forfeiture Penalties

Class A Forfeiture
A Class A forfeiture may result in a fine up to $10,000.

Class B Forfeiture
A Class B forfeiture may result in a fine up to $1,000.

Class C Forfeiture
A Class C forfeiture may result in a fine up to $500.

Class D Forfeiture
A Class D forfeiture may result in a fine up to $200.

Class E Forfeiture
A Class E forfeiture may result in a fine up to $25.

Forfeiture Imprisonment
Forfeitures do not require any jail time.
