Wisconsin Crimes Against Property

If a person obtains title to another person's property by intentionally deceiving the person with a false representation which is known to be false, made with the intent to defraud, and which does defraud the person to whom it is made, the the crime of larceny by trick has been committed and can be charged under Wisconsin law as theft by fraud, more commonly known as an embezzlement.

If one person who has a legal interest in property moves, conceals, sells, or otherwise disposes of property or prevents property from being used by other persons who also have a legal interest in the property with the intent to permanently deprive the other persons of the property, a theft has occured.

Intent

It must be the alleged defendant's intent to deceive. If he or she did not intend to deceive another person, then intent does not exist.

False Representation

The representation made by the alleged defendant must have been both false and known to be false to the alleged defendant.

Defraud

The representation known to be false must have been intended to defraud and actually defrauded another person or persons.
