Any person who has sexual intercourse in public commits public fornication. Public fornication is a Class A misdemeanor. [See Public]
Public Fornication (Having Sex in Public) With A Minor Child
If the act of fornication occurs with a minor child, public fornication is seldom charged; rather, a charge of sexual assault of a minor child would be brought against the person responsible for the sexual act towards the minor child.
Sexual Gratification
The crime of sexual gratification occurs when a person commits an act of sexual gratification in public involving the sex organ of one person and the mouth or anus of another person or animal, or the sex organ of an animal and the sex organ, mouth, or anus of a person. Sexual gratification does not include breast-feeding mothers. Sexual gratification is a Class A misdemeanor.
